Jon Eisenberg joins us to discuss al-Haramain v. Bush/Obama, the only case against the government’s illegal wiretapping that was permitted to proceed, and his experience in dealing with Orwellian government secrecy and abuses during his representation of this case. Mr. Eisenberg talks about the Obama administration and how it has embraced the power grab and abusive litigation tactics of the previous administration, and the rise of the police state in the United States.

eisenbergJon Eisenberg is an attorney with three decades of experience in appellate litigation. He has argued 11 cases in the California Supreme Court, and dozens in the California Courts of Appeal and Ninth Circuit. He is also a California State Bar Certified Appellate Specialist. In 2011 he received California Lawyer magazine’s “Attorney of the Year” (CLAY) award and was also named one of the Recorder’s “Attorneys of the Year” for his work on the Al-Haramain case. Mr. Eisenberg received his J.D. from Hastings College of the Law, where he was Associate Editor of the Hastings Law Journal and graduated Order of the Coif. His Bachelor of Arts is from the University of California at Irvine.

She provides us with her assessment of Obama’s presidency and his track record in not only maintaining but expanding the previous administration’s system of secrecy and abuse of power through authoritarian legal doctrines such as state secrets privilege. Ms. Cohn talks about the disappearance of separation of powers, the total abdication of responsibility by the US Congress, and the speedy rise of the police state in America today.

CohnCindy Cohn is the Legal Director for the Electronic Frontier Foundation as well as its General Counsel. Outside the Courts, Ms. Cohn has testified before Congress, been featured in the New York Times, San Francisco Chronicle and elsewhere for her work on cyberspace issue. The National Law Journal named Ms. Cohn one of 100 most influential lawyers in America in 2006 for “rushing to the barricades wherever freedom and civil liberties are at stake online.” In 2007 the Journal named her one of the 50 most influential women lawyers in America. In 2010 Intellectual Property Section of the State Bar of California awarded her its Intellectual Property Vanguard Award.

Revisiting 9/11 with a Bit of Accounting

The Big Picture vs. Drowning in Superficial Details Surrounded by Smoke & Mirrors

Sep11This morning Asia Times showcases a fairly decent article on 9/11, revisiting one of its many still-unanswered questions: ‘Was Saudi Arabia Involved?’ The article revisits the cases of hijackers Khalid al-Midhar and Nawaf al-Hazmi under CIA surveillance prior to the attack, the Alec Station and FBI bungling, Prince Bandar and his wife’s funneling of money to the hijackers, Saudi and supposed Bin-Laden connected suspects-witnesses flying out of the US under US government protection, the FBI being prevented from stopping or questioning these fugitives’ escape … basically the whole nine yards we 9/11 activists, witnesses, whistleblowers and experts  have been pointing out  for the last ten years plus.

Yawn. A cat-like stretch and a big yawn. Don’t get me wrong. I am not putting down the article. I am a big fan of Asia Times, and this piece is decent. Nothing wrong with decent articles-analyses on these highly censored 9/11 related topics by the mainstream and pseudo alternative media. I am not even calling it boring. Then what is my problem? FBI Enlists Internet Café Owners to Spy on Customers

The Government’s Pretexts for Arresting Virtually Anyone

cafeThe US government has developed massive surveillance capabilities to monitor communications, travel and financial transactions in this country and abroad. But, even the government cannot monitor everything Americans do—not directly, anyway.  Thus, it created the Communities Against Terrorism (CAT) program to enlist your friendly local businesses as spies for the Federal Bureau of Investigation (FBI).

The CAT program, funded by the State and Local Anti-Terrorism Training program (SLATT) is described as a “tool to engage members of the local community in the fight against terrorism.” The program interprets “local community” to mean businesses, and only registered businesses may access the program’s flyers listing “potential indicators” of terrorist activity.

Each flyer is designed for a particular kind of business. For example, this list was prepared for owners of internet cafes. Unquestionably, someone planning a terrorist attack has engaged in one or more of the “suspicious” activities on that list. But so, too, have most of the estimated 289 million computer users in this country. Read more

rowleyColeen Rowley, a FBI special agent for almost 24 years, was legal counsel to the FBI Field Office in Minneapolis from 1990 to 2003. She came to national attention in June 2002, when she testified before Congress about serious lapses before 9/11 that helped account for the failure to prevent the attacks. She now writes and speaks on ethical decision-making and on balancing civil liberties with the need for effective investigation.
