This is Part II of our interview series on the Makings of a Police State. You can listen to Part I here.

Coleen Rowley joins us to share her views and thoughts on the state of the misleadingly named ‘criminal justice system’ in the United States today, and the extent to which the apparatus has been transformed into a police state. She discusses the recently signed National Defense Authorization Act (NDAA), the implications of this law for American citizens, and the troubling fact that many Americans are not aware of the serious threats to their liberties and rights posed by this police state enabling new law. Ms. Rowley talks about the Obama Administration’s increasing control of all information outlets together with the constant use of fear-hate-greed-false pride and blind loyalty propaganda to manufacture consent for the war machine as well as a panoply of other government-corporatocracy crimes, the escalating retaliation against government whistleblowers and government secrecy, FBI abuses and Director Mueller’s quietly extended term, and more!

<img style="vertical-align:text-center;float: left; padding: 3px 6px 3px 3px;"src="http://www.boilingfrogspost.com/wp-content/uploads/2010/01/Rowley.png" alt="rowley" />Coleen Rowley, a FBI special agent for almost 24 years, was legal counsel to the FBI Field Office in Minneapolis from 1990 to 2003. She came to national attention in June 2002, when she testified before Congress about serious lapses before 9/11 that helped account for the failure to prevent the attacks. She now writes and speaks on ethical decision-making and on balancing civil liberties with the need for effective investigation.

This is Part I of our interview series on the Makings of a Police State.

Shahid Buttar joins us to discuss the continuous erosion of our civil liberties from illegal domestic surveillance to Guantanamo, NDAA and its discretionary detention provision authorizing the President to detain Americans accused by the government of supporting terrorism. Mr. Buttar talks about the many abuses committed by the unchecked Federal Bureau of Investigation, the extension of FBI Director Robert Mueller’s Term quietly and readily by Congress, its significance and troubling implications, the capacity of the FBI to be used for political purposes established since the Hoover days, the US media’s silence on this significant issue, and more!

<img style="vertical-align:text-center;float: left; padding: 3px 6px 3px 3px;"src="http://www.boilingfrogspost.com/wp-content/uploads/2012/01/Shahid-Buttar.png" alt="SButtar" />Shahid Buttar is the executive director of the Bill of Rights Defense Committee and the People’s Campaign for the Constitution (PCC). He received his J.D. from Stanford Law School in 2003, where he served as executive editor of the Stanford Environmental Law Journal and as Professor Lawrence Lessig’s teaching assistant for Constitutional Law. In addition to his work leading BORDC, Shahid serves on the advisory bodies of the Rights Working Group, the National Coalition to Protect Civil Freedoms, and the National Campaign to Restore Civil Rights. He also supports populist constitutionalism as a civil rights lawyer, independent columnist, community organizer, and hip-hop and electronica MC. In his creative capacities as a poet and musician, Mr. Buttar has performed around the world, co-founded several grassroots art and culture groups around the country, facilitated workshops for young people and emerging artists.

Taser: Popular Technology of Pain Compliance in Law Enforcement

The popular conception of the police state, derived mainly from works of science fiction,
revolves heavily around the deployment of exotic technologies for keeping the populace firmly under the thumb of an authoritarian government. Perhaps it is the frequency with which these devices are presented to us in fictionalized form that prevents many from noticing that this technology is not the stuff of sci-fi fantasy, but increasingly a part of our everyday lives.

Jack Cover, a NASA researcher, began development on the taser which was completed in 1974, although not widely adopted by police departments until the last decade. Since its inception as a standard police implement the taser has courted controversy, with critics blaming the weapon for as many as 515 American deaths since 2001. It has also been denounced by the United Nations Committee Against Torture, Amnesty International, and other organizations as a potential weapon of terror.

This is our EyeOpener Report by James Corbett, introducing and presenting the taser, the use and implementation of this ‘pain technology’ in other settings, including airplanes, airports as the front line of the police state and a testing ground for new police state technology, and how the police, TSA and other law enforcement agents are being actively recruited and encouraged to be as aggressive as possible in dealing with the public, and aided in doing so by the federal government, the courts, and the upper ranks of their own departments.

‘Lockheed Martin Goes to Bat for’ …Who?

<img style="vertical-align:text-center;float: left; padding: 3px 6px 3px 3px;"src="http://www.boilingfrogspost.com/wp-content/uploads/2012/01/0105_WashingtonTimes.png" alt="washingtontimes" />Yesterday Justin Elliott at Salon reported on an international media-lobbying intrigue involving Bahrain, a Lockheed Martin executive and the Washington Times:

A top executive at Lockheed Martin recently worked with lobbyists for Bahrain to place an op-ed defending the nation’s embattled regime in the Washington Times — but the newspaper did not reveal the role of the regime’s lobbyists to its readers. Hence, they did not know that the pro-Bahrain opinion column they were reading was published at the behest of … Bahrain, an oil-rich kingdom of 1.2 million people that has been rocked by popular protests since early 2011.

The episode is a glimpse into the usually hidden world of how Washington’s op-ed pages, which are prized real estate for those with interests before the U.S. government, are shaped. It also shows how Lockheed gave an assist to a major client — Bahrain has bought hundreds of millions of dollars of weapons from the company over the years —as it faces widespread criticism for human rights abuses against pro-democracy protesters.

…

<img style="vertical-align:text-center;float: right; padding: 3px 3px 3px 6px;"src="http://www.boilingfrogspost.com/wp-content/uploads/2012/01/0105_prostitute.png" alt="prostitute" />The story is worth reading. Just remember this is an itsy bitsy tiny little case; only one example of many more similar cases occurring regularly. Hello? Think about our Congress and over 400 lobby-able crooks in it. Think about our government providing perks and access to ‘select’ reporters for being good pet boys. Think about dime-a-dozen plentiful retired generals linking their MIC bosses to the mighty purchaser Pentagon…on a daily basis hundreds of prostitution transactions like the one with the Washington Times. Come to think of it, one major difference between the examples I’m providing and prostitution in the true sense of the term is that usually the American public is at the center of services and transactions provided. That is, the services and products offered are their hard-earned dollars, their liberties, their security, their gullibly misplaced trust…

Let’s take Salon’s exposé on the Washington Times. The paper and the reporter appear to be the prostitutes. Now, figuring out the pimp(s) and distinguishing it from the client is a bit more difficult. You see, at first glance it looks like Bahrain is the client, and the Lockheed Martin Executive is the pimp, right? But if you really look at it you’ll see Lockheed Martin as the ultimate beneficiary: too much publicity on our Bahraini puppet regime may bring a few sanctions, and those sanctions may include an arms embargo, and then Lockheed Martin may lose a few hundred million dollars (peanuts of course, but hey…). Let me show you one example of the stakes for LM:

SYRACUSE, NY, October 2nd, 2007 — Lockheed Martin [NYSE:LMT] has delivered an AN/TPS-59(V)3B ballistic missile defense radar system to the Kingdom of Bahrain. The radar proceeded smoothly through a site acceptance test in August and now is being used by the Bahrain Defence Force for air surveillance. In May 2004, the U.S. Marine Corps awarded Lockheed Martin a $43.6 million contract to provide the long-range radar system to Bahrain, along with associated supplies, equipment and services, as a foreign military sale (FMS).

So ordinarily, in more US Congress-like scenarios, we’d have the pimps aka the lobby firms; we’d have the client, let’s say a MIC firm or a pharma or a foreign country, and then, we’d have the prostitutes: our elected representatives…

<img style="vertical-align:text-center;float: left; padding: 3px 6px 3px 3px;"src="http://www.boilingfrogspost.com/wp-content/uploads/2012/01/0105_LM.png" alt="LM" />In this particular case there seems to be an absence of a ‘pimp.’ Pretty cost effective, efficient, direct and smart: the client, Lockheed, goes to the prostitute directly and gets ‘his thing’ done, but the Arab Sheikh pays for ‘the thing.’ But wait a minute, the ultimate payment, the real dough, is going to ultimately be paid to Lockheed for all those ‘arms.’ So, in a way, we are looking at a sucker paying a client for going to and getting his ‘thing’ done with a media prostitute …

Okay it gets a bit confusing. We have these sucker puppet Arab regimes. We have MIC or Oil as ultimate clients, and then, we have the media as … what? It is the ‘John’ the client who is getting paid, so it is not exactly prostitution because that would be too noble for what these guys in the media are and do. It is more like a whore than a good ole fashioned prostitute. Then allow me to recap one more time:

In this latest US media exposé we’ve got a case of a ‘John’ and a ‘sucker’ and a ‘whore’; no?

The Fed & the Goal of Pursuing ‘Maximum Employment, Stable Prices & Moderate Long-Term Interest Rates’

In the 1960s and 1970s, amidst accelerated government spending on foreign affairs (including the Vietnam War) and domestic programs (the ‘Great Society’), as well as accommodative Federal Reserve monetary policy, inflation also accelerated significantly. Here’s a look at the Consumer Price Index from 1950 to 1977:

Over time, the body politic experienced a spreading realization that you can’t get something for nothing, and that accelerating inflation was undermining real economic growth. In 1977, in the Federal Reserve Reform Act, the Congress added new explicit goals for the Federal Reserve while conducting monetary policy. The Fed was to pursue ‘maximum employment, stable prices, and moderate long-term interest rates.’ Those goals remain the same today.

How has the Fed done? Did the CPI go up, down, or sideways? Here’s a look at the CPI since 1977, when the Fed was first directed to pursue ‘stable prices’:

The rate of increase in the CPI may have slowed from the 1960s and 1970s, but the law doesn’t direct the Fed to pursue ‘stable inflation.’ It calls, rightly or wrongly, for ‘stable prices.’ And the CPI has nearly quadrupled since the Fed was directed to promote them.

The stuff we buy costs us over three times as much as it did when our Congress directed our monetary authority to keep their prices stable, on average.

Does the law matter?

$433 Million for a Disease that Hasn’t Been…

<img style="vertical-align:text-center;float: left; padding: 3px 6px 3px 3px;"src="http://www.boilingfrogspost.com/wp-content/uploads/2011/11/1116_Perelman.png" alt="Perelman" />Did you know that we haven’t had a single case of smallpox in the United States for over 60 years? To be exact, the last case of smallpox was in 1949. So, why would Obama hand out $433 Million, let’s put the zeros all in there to get a better sense, $433,000,000, on experimental smallpox drugs? Ain’t that a logical question to ask?

You see there is this billionaire guy. His name is Ronald Perelman, and he is one of the world’s richest men who happens to be a longtime Democratic Party supporter. This Obama-Backer Perelman guy owns stock in Siga Technologies Inc., which received the smallpox drug contract over the objections of specialists in the Department of Health & Human Services.

So, what happened to those who objected to this outrageous sum being paid for ludicrous unjustified experimentation? Well, the department’s lead negotiator for the deal who objected to Siga’s financial demands was replaced. Poof. Just like that.

But wait, that’s not all. The Obama administration also blocked other companies from bidding on the work, to ensure that Siga received a non-competitive contract deal.

Siga will be delivering 1.7 million doses of smallpox drug to our government “in case” there’s ever a bio-terror attack. Aha. Let’s remind ourselves again with hard data:

The last time an American was diagnosed with the disease was 1949, and the last case of naturally occurring smallpox anywhere in the world was in 1977.

So my friends, what are you going to do about it? Are you thinking of contacting your congressional representatives? I think you better think twice before wasting your time and energy. You see, congress is following the same trend-just like their corrupt stinking con president. Let me get more specific here:

Senator Feinstein Loaded Up on Biotech Stock Just Before Company Received $24 Million Government Grants

<img style="vertical-align:text-center;float: right; padding: 3px 3px 3px 6px;"src="http://www.boilingfrogspost.com/wp-content/uploads/2011/11/1116_Feinstein.png" alt="Feinstein" /> With a new congressional insider trading scandal unfolding in Washington, another name has been added to the hit parade: U.S. Senator Dianne Feinstein (D-CA)

In the new blockbuster tell-all Throw Them All Out, investigative reporter and Breitbart editor Peter Schweizer reveals that on November 18, 2009, Sen. Feinstein and her husband invested $1 million into Amyris Biotechnologies, a “green” company focused on plant-based renewable fuels and chemicals. The Feinsteins’ million-dollar investment was their only stock transaction for the entire year.

Feinstein, however, had good reason to feel that all her investment eggs were secure in the biotech basket, because just weeks after her seven-figure investment in Amyris, the company scored a $24 million grant from the Department of Energy (DOE) to build a pilot plant where altered yeast would turn sugar into hydrocarbons.

The company went public the following year with an IPO that raked in $85 million. Currently, it’s unclear exactly how much money Senator Feinstein and her husband made off their investment, “but it’s safe to assume that they did well,” concludes Schweizer.Do we know for certain that Feinstein’s willingness to bet $1 million bet on Amyris was the result of insider knowledge that the DOE’s $24 million infusion of federal funds was forthcoming? No, not without further investigation.

You see why? You see, most Members of our Congress have been enjoying a robust financial status despite our sluggish economy in crisis.

Of course these two cases are just an aperitif for many bigger cases. You still remember Solyndra? Congress Insider Trading Scandal?

Now, I am looking for a savvy music tech volunteer to slightly modify the lyrics of the following song for us: Money for Nothing ….Where have all our Dollars Gone

Come on people. Do we have volunteers to update this great song to fit our nation’s out of control, unaccountable and corrupt leaders who’ve been giving out our billions of hard-earned dollars for “Nothing” while filling up their own greedy pockets?

The office of the Director of National Intelligence announced last month that America’s civilian intelligence agencies appropriated a combined 54.6 billion dollars for classified operations this year, but he explicitly refused to provide any details of how the figure was divided up between America’s 16 non-uniformed intelligence agencies or what the money was appropriated for.

Intentionally and daringly withheld from the public is the amount of funds that the CIA has to use for its so-called “black operations,” or covert actions. What is the size of the CIA’s budget, and where is this money parked?

The question is even more difficult to answer than it first appears. Not only is there the issue of the funds that they receive in secret from Congress, and not only is there the ever-present question of how black operations use illegal methods to finance further illegal covert operations, there is also the question of the CIA literally setting up businesses, front companies, and shells, that function, from the outside, like any other business. Behind the scenes, however, these businesses are merely a place for the CIA to nest its covert operatives, and, potentially, to make and funnel money for their own purposes.

This is our EyeOpener Report by James Corbett, presenting well known and exposed facts, questions, and intrigues on the CIA’s front companies and its connections to the murky world of money laundering and shady financial institutions, to secretly and illegally fund their immoral black operations around the world.

Grant F. Smith joins us to discuss Start-Up Nation: The Story of Israel’s Economic Miracle, a 2009 Council on Foreign Relations book authored by Dan Senor and Saul Singer. He tells us about rarely discussed “massive non-market subsidies and distortions” designed and implemented to benefit Israel, such as an agreement with the Pentagon for Israel to provide goods and services to the US military, and gain access to the US military procurement system, and other congressionally approved agreements that create jobs in Israel rather than in the US. Mr. Smith talks about AIPAC, Israel’s vast network of legal and illegal campaign contributions, their influence and propaganda infrastructure with the US media, and more!

The Devolution of the People & Government Czars, Halfhearted Congressional Gestures, Obama’s Drone Obsessions, and More!

I am going to list a few noteworthy articles and commentaries from this past week, and I am going to make it very brief. I am sure you have heard that before. Okay, it will be relatively brief; emphasis on ‘relatively.’ Those of you who have gone through selling your house, while living in it, especially with a kid or two or three …, well, you know how annoying it can be. You get a short notice, you run around trying to organize, clean, put away toys (including those hidden under the sofa, tucked behind the sink …), and then, you have to ‘evacuate’ your house for the potential buyer…Now you have the reason behind the ‘relatively brief’ round up.

I hope you enjoyed our interview with Tom Woods. We also recorded a great interview with Grant Smith on Israel and the Israel Lobby which will be posted next Friday. I don’t know why but I’ve been getting tons of good comments/responses at Facebook, and very little feedback here at BFP. Any ideas as to why? Please let us know.

Here are my noteworthy items from this week:

The Good Taliban, The Bad Taliban, The Ugly Taliban- different or one & the same?

<img style="vertical-align:text-center;float: left; padding: 3px 6px 3px 3px;"src="http://www.boilingfrogspost.com/wp-content/uploads/2011/04/417_Taliban.png" alt="taliban" />In May 2009 I wrote an article on the Obama presidency and the current American political party system as ‘Two Sides of the Same Coin … Heads-Heads.’ Here is what I wrote on our confused Afghan strategy:

It is another war with no time table. It is the continuation of the same abstract ‘War on Terror’ without any definition of what would constitute an ‘accomplished mission.’ One minute there is pondering on possible ‘reconciliation’ with the Taliban, and the next minute seeking to topple it. In fact, to confuse the matter even further, we now hear this distinction between ‘Good Taliban, Bad Taliban, and the Plain Ugly Taliban.’ As stated by Karzai on Meet the Press on May 10, 2009, not all Taliban are equal!!

And the following related news came out this past week:

Afghan Taliban to Open Office in Turkey
Voice of America

The Turkish foreign minister has confirmed that preparations are underway for opening an office in Turkey for the Afghan Taliban. During a recent visit to Turkey, the president of Pakistan, together with his Turkish counterpart, made a commitment to support political initiatives to end the war in Afghanistan. Ankara has been calling for talks with the Taliban, and having strong ties with both Afghanistan and Pakistan is seen as a key element in facilitating talks.

Turkey says it is willing to host a political office for Taliban militants from Afghanistan in order to promote talks to end the war there. An unnamed Afghan official is quoted as saying that planning for the office is already in progress.

…

But wait, that’s not the most noteworthy aspect of this news. You know how they say the devil is in the details? Well, here is the ‘devil’ in this development [emphasis all mine]:

Last week, a senior Afghan official, Mohammad Massoom Stanekzai, secretary of the Afghan High Peace Council and an adviser to Afghan President Hamid Karzai, announced a US$50 million donation from the United States government to the council – the body responsible for seeking peace talks with the Taliban – in support of reconciliation efforts.

This is the beginning of official; up-front peace negotiations with the Taliban, which to date have taken place in backrooms. However, in stark contrast to US hopes, the Wall Street Journal recently reported that al-Qaeda was gradually returning to the eastern Afghan provinces of Nuristan and Kunar, setting up bases for the first time in years in the wake of the withdrawal of US troops from the area to more populated centers.

Okay, let’s ask it out loud: who exactly have we been bombing in Afghanistan? Pakistan? Al-Qaeda? Taliban? Only the Bad Taliban? All of the above? None of the above? A mixture of good, bad, and [plain ugly Taliban? And, which Taliban are we funding and opening international offices for? I have a pretty good theory (maybe a hypothesis) on this, but that will have to wait for another time and another article…

…………………………………………………………………………………………

The Devolution of the People & the Government of the Czars

<img style="vertical-align:text-center;float: right; padding: 3px 3px 3px 6px;"src="http://www.boilingfrogspost.com/wp-content/uploads/2011/04/417_WeThePeople.png" alt="wethepeople" />Language and words people use tell a lot about their culture, values, even geographic characteristics and forms of government under which they live. But then again the situation, circumstances, change or evolve, and with them the language and the use of some words. Once upon a time, here in our country, government workers were referred to as public servants, and it wasn’t that unusual to hear expressions like ‘government of the people, by the people…’ Back then, people hated words associated with kings, queens, emperors … But then, things devolved. Really, devolved big time. We went from a small government to a gigantic one; from public servants to czars and czarinas. And, looking at the frequent and accepted usage of words reflecting this devolution, our society seems to have accepted the position of servants ruled by their masters…Here is what I had to say in an article:

I can go on listing cases of Mr. Obama’s change on change. Whether it is his reversal on protection for whistleblowers, despite his campaign promise to the contrary, or his expansion of the Un-American title of ‘Czardom,’ where we now have more czars than ever: Border Czar, Energy Czar, Cyber Security Czar…Car Czar…maybe even a Bicycle Czar!

…

President Obama Won’t Abide by Provision in Budget Bill
Jake Tapper, ABC News

In a statement issued Friday night, President Obama took issue with some provisions in the budget bill – and in one case simply says he will not abide by it.

…

One rider – Section 2262 -- de-funds certain White House adviser positions – or “czars.” The president in his signing statement declares that he will not abide by it.

“The President has well-established authority to supervise and oversee the executive branch, and to obtain advice in furtherance of this supervisory authority,” he wrote. “The President also has the prerogative to obtain advice that will assist him in carrying out his constitutional responsibilities, and do so not only from executive branch officials and employees outside the White House, but also from advisers within it. Legislative efforts that significantly impede the President's ability to exercise his supervisory and coordinating authorities or to obtain the views of the appropriate senior advisers violate the separation of powers by undermining the President's ability to exercise his constitutional responsibilities and take care that the laws be faithfully executed.”

…

During his presidential campaign, then-Senator Obama was quite critical of the Bush administration’s uses of signing statements telling the Boston Globe in 2007 that the “problem” with the Bush administration “is that it has attached signing statements to legislation in an effort to change the meaning of the legislation, to avoid enforcing certain provisions of the legislation that the President does not like, and to raise implausible or dubious constitutional objections to the legislation.” Then-Sen. Obama said he would “not use signing statements to nullify or undermine congressional instructions as enacted into law.”

…

And here are a few more links and excerpts for you:

Halfhearted Gestures & Another Case of a For-Show-Only Congressional Performance

Rep. Chaffetz seeks to limit pat-downs of children after new TSA controversy
Pete Kasperowicz, the Hill

Rep. Jason Chaffetz (R-Utah) on Wednesday introduced legislation that would prohibit Transportation Security Administration (TSA) officials from conducting pat-downs on minors without consent from a parent.

Chaffetz's bill, H.R. 1510, was spurred by video footage posted online over the weekend of a 6-year-old girl being patted down at an airport gate by a TSA official as her mother objected. Chaffetz wrote to TSA chief John Pistole on Wednesday to complain about what he called an "invasive pat-down at the hands of TSA personnel."

…

Chaffetz, who chairs the Oversight and Government Reform Subcommittee on National Security, warned Pistole that he would be introducing legislation, and said the agency "must get serious" about how it tries to balance national security and personal privacy."At the very least, it cannot continue to operate under the belief that little girls and handicapped children pose such a serious threat that [TSA officials] must abandon all manner of decency when interacting with them,” he wrote.

…

Okay, do you want to know what triggered this latest for-show-only performance; soon to be forgotten ultimatum? Here it is, watch it.

Obama’s Drone Obsession: They say a man obsessed with really big cars has a small…But what do they say about a man obsessed with drones?

<img style="vertical-align:text-center;float: left; padding: 3px 6px 3px 3px;"src="http://www.boilingfrogspost.com/wp-content/uploads/2011/04/417_drones.png" alt="drones" />US Ignores Pakistan Warning, Continues Drone Strikes
Jason Ditz, AntiWar.Com

Though Pakistani officials were quite clear on Monday in their demand that the US put its entire drone strike program “on hold” for the foreseeable future, drones were active again today in South Waziristan, attacking a village and killing at least six people.

…

The latest strike spawned another quick rebuke from officials, who insisted the attacks are “counterproductive” and are indeed being used as a recruitment tool by militant factions. The US has launched scores of such strikes since President Obama took office, killing massive numbers of people, many of them civilians.

…

The continued strikes had previously been done in the context of some backdoor agreements with officials to keep them going, but in the absence of those it seems the Obama Administration is betting Pakistan just doesn’t care enough about the constant bombardment of their tribal areas to actually do anything about it.

…

What Could Halt US Arms Sales to Any Middle Eastern Country? Nothing, really.

<img style="vertical-align:text-center;float: right; padding: 3px 3px 3px 6px;"src="http://www.boilingfrogspost.com/wp-content/uploads/2011/04/417_MidEastArms.png" alt="mideastarms" />U.S. reviewing Mideast arms sales
Andrea Shalal-Esa, Reuters

The U.S. government is reviewing arms sales to Middle Eastern countries on a “case-by-case basis” given turmoil in the region, and has already halted some sales, a Pentagon official said on Monday.

Richard Genaille, deputy director of the Pentagon’s Defense Security Cooperation Agency, said that two of the biggest deals on the table have been cleared to proceed: a $29.4 billion sale of 84 Boeing Co F-15 fighter jets to Saudi Arabia and a $7 billion sale to the United Arab Emirates of an advanced missile defense system built by Lockheed Martin Corp.

A team of officials from his agency, the State Department, military commanders and the White House National Security Council were carefully reviewing planned arms sales to the region, Genaille told Reuters in an interview after a speech at the annual Navy League conference.

Unrest and violence spreading across the Middle East have sparked questions about U.S. arms sales to the region, deals that many U.S. defense companies had hoped would offset an expected decline in U.S. defense spending in coming years.Genaille said the current reviews affected specific parts of arms sales that had already been approved by Congress and were being readied for delivery to Middle Eastern countries.

…

Earlier, Genaille told the conference that he expected continued strong foreign demand for U.S. weapons, predicting that the overall level of foreign military sales could exceed the currently forecast level of $46 billion in fiscal 2011, which ends on September 30, buoyed by the Saudi arms sales. The agency that oversees foreign arms sales reported $31.6 billion in new sales in fiscal 2010, according to its website.

The Saudi arms sales are likely to buoy sales in 2011, although the overall level will likely drop off and stabilize between $30 billion and $40 billion for several years. In October, the Obama administration notified Congress of a proposed arms sale to Saudi Arabia worth up to $60 billion over 15 to 20 years. It would be the largest arms deal on record if all purchases are made, including 84 Boeing F-15 fighter jets and upgrades to 70 more F-15s that the Saudis already have.

…

Hope you all had a nice weekend so far; enjoy the rest of it

…and so are so many other rights

I just received an email with a link to the following clip, and with the link came the headline that read:

‘Wikileaks Has Proven the First Amendment is Dead & Gone!’

Is the First Amendment dead & gone? You bet! Has it been dead and gone for a while now? You bet! Where have these people been? Don’t take me wrong. I agree with what’s being said, and I’m so very glad that it is being said; finally. Maybe it took this latest war (this has been resembling a war more and more every day) to get some people see the reality on the ground-make that, in our nation…and while you are at it, make that for almost a decade. So why is this the case?

Please chime in with your thoughts on this, because the last time I checked:

The Fourth Amendment was Dead & Gone: Think NSA illegal eavesdropping; think FBI national security letters…

The First Amendment was Dead & Gone: Think state secrets privilege; think gag orders; think NSA again…

The Notion and Function of an Independent Supreme Court was Dead & Gone: Just go check the last ten years’ rulings when it comes to cases against the ‘tyrannical federal government’ and you’ll see what I’m talking about…

The Separation of Powers was Dead & Gone: Be my guest and review the Congress’ track record on oversight and accountability and you’ll be done in less than a second – since that’s how long it will take to read a blank page…or look for anything showing states exercising their power or having their ‘say’ when ordered by the big fed…

The Adherence to US Military Code on Violations of Geneva Convention was Dead & Gone: Need I even elaborate?

Okay, don’t get me started again. I have already covered some of these issues…pretty intensely;-) Instead, let me know why we are among the irate and very minute minority who are seeing all these deaths!

…And Corrupt System of No-Checks & Many-Imbalances

<img style="vertical-align:text-center;float: left; padding: 3px 6px 3px 3px;"src="http://www.boilingfrogspost.com/wp-content/uploads/2010/11/YoYo.png" alt="yoyo" />I go on line and check out the major newspaper headlines, and to my delight there is a TSA related headline or two in every one. In the last few days two in every three e-mails I’ve received (and I receive hundreds a day) carry TSA related heads up or action items in their subject lines. The blogosphere has been simmering with the same outrageous issue. Yet the entire thing gives me pause. A long one. The pattern, the order, the intensity, the lingo, the reaction…all remind me of something or some things. It is a bit, maybe more than a bit, like a sense of déjà vu. The feeling that we’ve been here; more than once, actually many times. Make that too many times. I keep thinking of a yoyo. In fact, I can’t get the image of a yoyo out of my head. I am asking myself, and you, the following question: Are we Americans exhibiting yoyo-like and short-lived reactions? In short-lived jerky motions?

Let’s step back for a second and take a look at this consistent pattern:

NSA illegal wiretapping of American citizens is exposed. We, some of us, are outraged. We can’t stop reading about it. We write about, talk about it, and blog about it nonstop. For a while. The media waits a little, then takes the cue, decides to ride the same wave, however selectively and reluctantly. For a while. The Congress follows the fashion. They are into fashion. They wear this particular fashion like a Halloween costume, over the top of their usual long-term clothing, with every intention of shedding it off at the end of the parade, as soon as it is announced out-of-fashion.

Within a few weeks the media goes back to ‘normal,’ and acts as if ‘it’ never happened, or, it happened but no longer carries newsworthiness since ‘it’ has become another ordinary fact of life to live with and forget it is even there. The Congress likes to remain fashionable. When the media stops, the costume is out-of-fashion; to be discarded. Their usual clothing underneath are ‘classics,’ politically that is, the kind that never go out of fashion, politically, that is. So they go back to the good old classics until the next fashion trend breaks in the news. During this phase, we the people gradually stop reading, talking, writing, and blogging about ‘it.’ We are exhausted from over-excitement. Frankly, we are bored with the topic. For weeks we all had run in the same direction; fast and furious. Everyone within our circle had covered the same ‘topic,’ and the topic started getting too familiar, too common, too ordinary, too tedious and too massive to go against. All in a very short time, but nonetheless.

…and this when the next ‘scandalous’ issue hits. Hooray! We have another scandal and another cause; another outrage. Maybe it is torture, and thousands of documented pictures and reports to go along with it; all committed in our name and with our money. Maybe it is the FBI raiding peaceful protestors’ homes for exercising their constitutionally guaranteed rights. Maybe it is major intentional falsifications of facts to drag us all into another war, where we spend billions, kill, and get killed for some made-up cause enriching a few cause-makers. Maybe it is the TSA fondling, groping, and pretty much raping we the people on a daily basis for some made-up, perceived secuity.

No matter what the ‘current,’ or, ‘fashionable,’ or ‘newsworthy’ cause, scandal, or issue, we run back and forth like yoyos, run towards the ‘new cause,’ hold on to it for a short-while, repeat the above steps with the media taking up the trend and Congress sporting the fashion, blogs fuming collectively… basically going around the same circle, completing the same short-lived cycle, then eventually we retreat, and after that, another case of major violation or abuse breaks or gains momentum, we run towards it, pose to confront and challenge it, write-talk-blog about it…

You do see the yoyo I am talking about here, don’t you? What happened to our outrage, a handful of posturing lawsuits, and relentless pledges declared in the face of being illegally wiretapped and spied upon? How long has it been since we found out and became outraged, signed on to hundreds of petitions against it, bombarded the ‘fashionable’ representatives with mails-e-mails and calls? How long has it been since we’ve seen it covered in bold by our media? How long has it been since we’ve heard it discussed or even referred to by those elected as ‘an issue’ or ‘problem’? Here is the most important question of all:

How long has it been since we have either acknowledged or consciously thought about the fact that we are actively, unconstitutionally, and belligerently under surveillance by our government and their plentiful contractors and collaborators?

Please don’t take me wrong. I stand by my word in the introduction section of this article. I am truly delighted by what I see in terms of movements in reaction to TSA’s raping of our rights and dignity. It is just that I see this particular abuse-violation as one of many symptoms of our broken system, suspended Constitution, and a corrupt and abusive system of No-Checks & Many-Imbalances. The real diseases are not getting much, if any, attention. And we the people seem to be inflicted by a chronic case of a symptoms-chasing yoyo syndrome. It is way past time to look to curing and rehabilitating ourselves from this freedom-threatening syndrome, and go after the real diseases and causes.

Please take a moment and look at these pictures. Really look at them. Not just a cursory glance or a rushed and distracted glance.

Isn’t it heartbreaking looking at them? Isn’t it revolting and outrageous?

Next, please read, process, and think about the following few lines. I mean, really take them in and truly process their meaning and implications.

The severely injured and crippled children in these pictures are innocent victims of ‘our’ bombings in Afghanistan.

We, you and I, paid for every miniscule molecule of the bombs that brought this horror upon these innocent children. We financed the entire assault with our tax money, so are rightfully considered the financiers of what fell upon these innocent children.

Our representatives, the ones we elected and gave power to, decided upon and sanctioned these atrocities on our behalf, and in our name. We, you and I, likewise sanctioned them, and consented to become the financiers of their implementation.

We, you and I, are directly responsible for what you see in these pictures, and much worse and more, and implicating many more.

We, you and I, did ‘this’, and we are still doing it.

Now please tell me, should it matter whether you are pro-choice or pro-life when it comes to ‘this’ and your reaction to ‘this’?

Because if you are prochoice I doubt you’d make ‘this’ a choice of yours; as a decent human being. Or, if you are prolife I seriously doubt you’d sanction and finance ‘this,’ – do ‘this’ to other fellow human beings. After all, isn’t ‘a life a life…’?

Please tell me, should it matter whether you are a conservative or a liberal when it comes to ‘this’ and your reaction to ‘this’?

Because if you are a true conservative I believe you would be pro-defense not pro-offense, and offenses such as ‘this’ would offend you a great deal. And if you consider yourself a liberal, then I assume you hold high a human’s right to live and exist with dignity, no matter who or where they are.

Please tell me, should it matter whether you are a Christian, Jew, Muslim, or Buddhist when it comes to ‘this’ and your reaction to ‘this’?

Because if you truly have faith in the teachings of either Jesus, Moses, Mohammad, or Buddha, you go by their universal teaching and common proclamation that ‘Thou Shall Not Kill,’ not ‘thou shall sanction and condone violence like ‘this’ on ‘innocent lives’ in the name of false security and under the excuse of terror.’

Should it matter whether the children above are Afghans, Mexicans, or Americans? Are these lives worth less than others; less than ours? Wouldn’t have we been livid, fuming with rage and determination to seek justice, even if only one of these innocent children was on our soil attacked by foreign mighty powers, intentionally or not?

So please tell me, why do we stand divided when it comes to ‘this’?

Why is it that we go on sanctioning and financing ‘this,’ these outrageous and revolting offenses that are being brought upon real lives; innocent human lives?

Why can’t we unite on ‘this,’ a truly significant issue that deals with life and death?

Why don’t we put aside other differences, and jointly take a stand, as pro-choice, pro-life, conservative, liberal, Christian, Jew, Muslim, and Buddhist, who should all consider ‘this’ a significant violation of what we believe in?

Isn’t it time? Looking at these pictures, I say it is way past time. Don’t you?

National Security Letters: In Peril or Deep Trouble?

When even one American – who has done nothing wrong, is forced by fear to shut his mind and close his mouth then all Americans are in peril- – Harry Truman

I don’t know what you think of our ex President Harry Truman; as with all our presidents he too came with a mixed bag of good and bad. For our discussion here it really doesn’t matter where we stand on Truman. On the other hand, the quote provides an excellent starting point for my Part III of the Makings of a Police State: National Security Letters. I wish we could bring President Truman back to life and ask him the following question:

Mr. President, if forcing only one American to shut his mind and close his mouth means that all Americans are in peril, what happens when thousands of good American citizens are forced to shut their mouths?

I wonder what his answer would be. Perhaps something like ‘…then all Americans are in real deep trouble!’ Or, ‘…then we are all doomed!’ Or maybe, ‘…then all Americans deserve it for not rising up and grabbing our pitchforks!’

If you think I am talking in riddles and hypotheticals, you are dead wrong, and can be thankful to our media for keeping you in the dark. Here is a documented statement on the state of our liberties when it comes to the government forcing us to shut our mouth when we see and witness evil & wrongdoing:

A federal appeals court may have slapped the Federal Bureau of Investigation last year for its misuse of gag orders to prevent discussion of government investigations conducted under the authority of National Security Letters, but that hasn’t slowed the feds very much. According to the American Civil Liberties Union, despite a court’s finding that such gag orders are constitutionally suspect and should be subject to judicial review, the FBI continues to muzzle recipients of the controversial letters, preventing them from participating in public debate over the Patriot Act and the security state.

National Security Letters are powerful tools that allow federal agents to obtain information about investigation targets from third parties, such as telephone companies, financial institutions, Internet service providers, and consumer credit agencies on their own say-so, without judicial review. Some 47,000 such letters were issued in 2005 alone, according to the Department of Justice’s Office of the Inspector General (PDF). The letters don’t receive much public discussion, probably because many of the recipients are also issued gag orders, forbidding them to discuss the experience.

Okay, let me preempt you before you rush and make wrong assumptions about who the recipients of these government gag orders are, before you start envisioning the stereotyped boogie-looking-men in shalvars with long flea-infested curly dark beards:

Unable to speak out about their experiences as the subjects of National Security Letters, recipients of such letters, including businesspeople and librarians, can only stand on the sidelines while the discussion is conducted in theoretical terms.

That’s right! We are talking about good ole ordinary American citizens like librarians, small business owners, and in some cases healthcare providers. Also, the 47,000 number mentioned above is only for the year 2005. In a report published by the Bill of Rights Defense Committee an Inspector General Report delivered to Congress found that there were 143,074 NS Letters requested in two years, between 2003 and 2005. And here is another fire-raising fact from the same report:

From the 143,074 NSLs requested, there was only 1 confirmed terrorism-related conviction.

That’s right. And each NSL may demand tens of thousands of records containing private information on Americans. So please do the math by multiplying 143, 074 with let’s say 1000 to be safe, and let it sink in. Now put that number next to the ‘1’ terrorism case they had, and try to come up with a single sane reason or justification for our government going after, demanding, obtaining and then keeping these records.

Okay, back to what our President Truman considered ‘being in peril.’ Let’s get a bit up close and personal with one of the thousands of NSL recipients. This one happens to be extraordinarily brave since we have his name. Thousands of other recipients are prohibited, or intimidated into think they are, from disclosing their identity – thanks to the Gag Provision imbedded in this unconstitutional police tool called NSL, handed to our federal police by our Congress. Let’s get a bit acquainted with the brave NSL and gag order recipient, a librarian named Peter Chase, through an article published by the Baltimore Sun:

“In 2005, Mr. Chase, the director of the Plainville, Conn., public library and then-vice president of a consortium of 26 Connecticut libraries, received an FBI demand for library patron records via a National Security Letter authorized under the Patriot Act. The FBI also imposed a gag order prohibiting him from speaking to anyone about the demand – including Congress, when the Patriot Act was up for reauthorization in 2005.

Now, thanks to the American Civil Liberties Union, Mr. Chase has finally won the legal battle and has torn the Bush administration’s tape from his mouth. So he’s speaking out, and this is what he has to say: “The government was telling Congress that it didn’t use the Patriot Act against libraries and that no one’s rights had been violated. I felt that I just could not be part of this fraud being foisted on our nation.””
…

Here is what I find the most disheartening, alarming, and simply frightening point in the above story: Peter Chase is one of only three brave Americans who have actually challenged the gag order imbedded in NSLs. Meaning what? Meaning of over 200,000 people who have received these unconstitutional police letters and the accompanying gag orders, ONLY 3 have found the courage, conviction, and real patriotism to stand up and challenge this assault on their constitutional rights and those of the entire nation. If this doesn’t rattle us Americans, the inhabitants of the land of the free, then may we deserve this and the highly probable worse to come.

Less than two months after the September 11 terrorist attack, while driven by panic and hysteria, our elected representatives rushed to enact the PATRIOT ACT, which was speedily, and conveniently, drafted by the Executive Branch. This unconstitutional set of laws handed our federal police and intelligence agencies unprecedented power to secretly and arbitrarily spy into Americans’ lives without any justification, any evidence of wrongdoing, or any oversight whatsoever.

Here are a few highlights on National Security Letters (NSL):

A National Security Letter (NSL) is a letter request for information from a third party that is issued by the FBI or by other government agencies with authority to conduct national security investigations. Government agency issues the request for information without prior judicial approval. Obtaining NSL requires no probable cause or judicial oversight. They also contain a gag order preventing the recipient of the letter from disclosing that the letter was ever issued. The non-disclosure rules have helped prevent the full extent of the NSL program from becoming known, as the FBI has systematically underreported to Congress the number of letters sent. Unlike other subpoenas and warrants, no approval from the Judicial Branch is required to issue an NSL. An NSL may be issued by “the Director of the Federal Bureau of Investigation, or his designee in a position not lower than Deputy Assistant Director at Bureau headquarters or a Special Agent in Charge in a Bureau field office designated by the Director” with no checks and balances in place until after the NSL has been delivered.

An internal FBI audit found that the bureau violated the rules more than 1000 times in an audit of 10% of its national investigations between 2002 and 2007. According to the September 9, 2007 New York Times report on the FBI’s use of NSLs to obtain broader information for data mining purposes, “In many cases, the target of a national security letter whose records are being sought is not necessarily the actual subject of a terrorism investigation and may not be suspected at all. Under the USA PATRIOT Act, the F.B.I. must assert only that the records gathered through the letter are considered relevant to a terrorism investigation.” (http://www.nytimes.com/2007/09/09/washington/09fbi.html?_r=1 )

In April, 2008, the American Civil Liberties Union alleged that the military was using the FBI to skirt legal restrictions on domestic surveillance to obtain private records of Americans’ Internet service providers, financial institutions and telephone companies. The ACLU based its allegation on a review of more than 1,000 documents turned over to it by the Defense Department in response to a suit the rights group filed in 2007 for documents related to national security letters.
…

The fear factor and the accompanying hysteria were the initial ingredients leading to the enactment of these laws befitting dictatorships and police states. The Bush-Cheney Administration’s war-mongering and absolute power-externally and internally, doctrine, kept the Patriot Act alive and in full implementation. The media fulfilled its significant role in promoting the fear-mongering which was, and is, the necessary ingredient in hushing the critics and hooraying the architects and implementers of the Patriot Act. Then came the President of Changes, and here is what he’s been doing to not only keep these unconstitutional police powers alive, but actually bolster them even further:

Last month, in a letter from the Justice Department to the Senate Judiciary Committee, the Obama administration went on record supporting the extension of key provisions of the USA Patriot Act, including the provision that gives the government the power to subpoena library records of any individual. The sections that our president is so keen to keep alive and take even further; allow roving wire taps on multiple phones, access to business records, and a never-used provision to conduct surveillance of a non-U.S. citizen who may not be part of a recognized terrorist group.
…

This same president, while an Illinois State Senator, considered the PATRIOT Act shoddy and dangerous and pledged to replace it. Well, as with all his promises of ‘change,’ he has done a hundred eighty degree change on this one, and been advocating for the continuation and expansion of this draconian police-state tool. You can read my brief piece on President Obama’s PATRIOT ACT Advocacy here.

While the federal police and intelligence agencies snoop on ordinary Americans and slap them with gag orders (forced by fear to shut their mouths), the public outrage appears to be in very short supply. Well, when you think of it, if of the known 200,000 + recipients only 3 refuse to shut their mouth, what would be a reasonable expectancy for hundreds of millions of Americans who don’t think these police-state practices affect their lives whatsoever?

How in the world did we get here? With hundreds of thousands of Americans being forced to shut their eyes, minds, and mouths, are we all in peril? In real big trouble? Doomed? And if you are like me and answer ‘yes,’ where is the outrage translated into action? Are we still sitting and waiting for a lobby and interest driven Congress to act in our behalf? Do we hope to see a President’s changes on his promised changes do yet another 180 degree change and change this? Or have we given up all hope and chosen to sit on the sidelines with our mouths shut waiting to be totally doomed?
